More points will be awarded to establishments that plan to offer better terms and a conducive working environment for all its staff.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-11fa3159 elementor-widget elementor-widget-heading\" data-id=\"11fa3159\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Terms Governing Licensed Illinois Adult Use Cannabis Dispensary Closures<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-64b3687d elementor-widget elementor-widget-text-editor\" data-id=\"64b3687d\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>All dispensaries will be required to promptly notify the licensing department in case they do not wish to renew their operating license. The duration allowed for this notice is at least 3 months before the date of closure.<\/p><p>The dispensaries will be required to work with the licensing department to establish a closure plan. This plan \u201caddresses, at a minimum, the transfer of business records, transfer of cannabis products, and anything else the Department finds necessary\u201d.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-348355c elementor-widget elementor-widget-heading\" data-id=\"348355c\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Regulation of Illinois Cannabis Dispensaries Impact its Applications<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-98c1de6 elementor-widget elementor-widget-text-editor\" data-id=\"98c1de6\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>The local law, police, and the licensing department will have a right to do random unannounced inspections on any cannabis dispensaries in the state. In addition, law enforcement officers will have a right to access all cannabis related products, materials, and even records.<\/p><p>In case there are any allegations where the dispensary is suspected to have broken the law, the department may conduct an investigation of the \u2018\u2019applicant, application details, dispensing organization, principal officer, dispensary agent, third party vendor, or any other party associated with a dispensing organization\u201d.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7562babf elementor-widget elementor-widget-heading\" data-id=\"7562babf\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Punishment of Illinois Cannabis Dispensaries for Failure to Follow the Law<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-55a976da elementor-widget elementor-widget-text-editor\" data-id=\"55a976da\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>According to the new Illinois Cannabis Act, \u201cthe Department may issue nondisciplinary citations for minor violations\u201d. These citations may attract a fine that \u00a0cannot exceed $20,000 for every violation. The citation will be charged on the person who holds the dispensary license. A licensee can request for a hearing within 30 days since the day the citation was served. Once this time has elapsed, the citation will become final and cannot be disputed.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2a3dacb elementor-widget elementor-widget-heading\" data-id=\"2a3dacb\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">The law is clear that the licensing department may, \u201cdeny issuance, refuse to renew or restore, reprimand, place on probation, suspend, revoke, or take other disciplinary or nondisciplinary action against any license\u201d. Some of the ways that dispensaries may break the law include:<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2360809f elementor-widget elementor-widget-text-editor\" data-id=\"2360809f\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<ul><li>Misstatement of information submitted to the licensing department<\/li><li>Obtaining the marijuana license through fraudulent means<\/li><li>A pattern that displays incompetence in the way a dispensary handles its business<\/li><li>Violation of the cannabis act and rules<\/li><li>Engaging in unethical behavior that could be damaging to the public. Anyone from the public can report any unethical behavior by the dispensary, and law enforcement officers will do their part to investigate the claims.<\/li><\/ul><p>The department may also choose to suspend the operations of a dispensary. After a suspension notice is issued, the licensee is allowed to request for a hearing within 45 days. If the department does not honor this request, the suspended license is automatically reinstated once the 45 days have elapsed.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7a6cc25 elementor-widget elementor-widget-shortcode\" data-id=\"7a6cc25\" data-element_type=\"widget\" data-widget_type=\"shortcode.default\">\n\t\t\t\t\t\t\t<div class=\"elementor-shortcode\"><div class=\"typeform-widget\" data-url=\"https:\/\/form.typeform.com\/to\/yYdgiw3K?typeform-medium=embed-snippet\" style=\"width: 100%; height: 500px;\"><\/div> <script> (function() { var qs,js,q,s,d=document, gi=d.getElementById, ce=d.createElement, gt=d.getElementsByTagName, id=\"typef_orm\", b=\"https:\/\/embed.typeform.com\/\"; if(!gi.call(d,id)) { js=ce.call(d,\"script\"); js.id=id; js.src=b+\"embed.js\"; q=gt.call(d,\"script\")[0]; q.parentNode.insertBefore(js,q) } })() <\/script><\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-680779f elementor-widget elementor-widget-heading\" data-id=\"680779f\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">What are The Requirements to Start a Licensed Cannabis Dispensary in Illinois?<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f63f1c9 elementor-widget elementor-widget-text-editor\" data-id=\"f63f1c9\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Aside from obtaining an operating licensing, there are other Illinois dispensary license requirements that those who wish to establish dispensaries will be required to fulfill. After January 1, 2022, the conditional aspect of the dispensaries becomes more permanent \u2013 but cannot exceed 500 new dispensaries\u2019 in the state. Unless more supply is needed. More on that in other videos.<\/p><p>So let\u2019s talk about what specifically must go into those license applications for the first wave of conditional adult use dispensaries.<\/p><p>First \u2013 the law provides for geographic dispersion of the dispensaries. \u00a0Here\u2019s the list of who gets what for the first wave \u2013 perhaps you can see an outlier or two, why does bloomington only get one when peoria gets 3 \u2013 we are just cooler than those insurance peddlers \u2013 and of course chicago area gets 47.<\/p><p>Moving down the line on Section 15-25 \u2013 we come to the requirements for the application. \u00a0Before we go through that \u2013 please be sure to view these through the lens of how the application will be scored. \u00a0Therefore \u2013 we begin with Section 15-30(c) of the cannabis law.<\/p><p>250 points will be awarded to the complete applications \u2013 and then the State picks the winners. \u00a0Here\u2019s the big point \u2013<strong>\u00a0Security and Record Keeping 65 points.<\/strong>\u00a0That\u2019s right more than 25% of your points come from security and record keeping \u2013 and I\u2019ve seen some client records, how good are your records \u2013 Jeffery? \u00a0To the guy named Jeffery watching this \u2013 I hope I freaked you out.<\/p><p>Just as important as\u00a0<strong>Security &amp; Record keeping are Business Pla, Financials, Operating and Floor plan \u2013 65 points.<\/strong>\u00a0\u00a0We will be doing videos on some providers of these services on our cannabis legalization news \u2013 so hit the subscribe button to tune in to that, and if you\u2019re in the industry with knowledge of these points \u2013 feel free to visit me at cannabis industry lawyer and give me a call.<\/p><p>So now with more than\u00a0<strong>50% of the points awarded for the cannabis dispensary licenses<\/strong>, we turn to the next most important thing on your application. It is worth 50 points. \u00a0We have always said cannabis is a team sport and a big member of the team in Illinois\u2019 legal marijuana market is social equity \u2013 20%<\/p><p>Next, we go to 3<strong>0 points for Knowledge and Experience in the industry \u2013<\/strong>\u00a0it is important because the quality of the product in the state has greatly improved in the past 2 years that I have had my card and some excellent producers are out there now \u2013 and I think the craft grows will bring more \u2013 and there is some overlap between craft grows and dispensaries so look for that synergy.<\/p><p>Before we get to miscellaneous matters, the last double digit point is the Employee Training Plan \u2013 worth 15 points. \u00a0This is also required under the application \u2013 and one of the reasons they will be quite expensive to put together.
