Lawmakers passed recreational cannabis legislation in July of 2017.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">The <a href=\"https:\/\/masscannabiscontrol.com\/applicants-licensees\/\" target=\"_blank\" rel=\"noopener\">Cannabis Control Commission (CCC)<\/a> is responsible for promulgating regulations relating to marijuana, processing business applications and issuing licenses, and creating policies and procedures which \u201cpromote and encourage full participation in the regulated marijuana industry by people from communities that have previously been disproportionately harmed by marijuana prohibition and enforcement and to positively impact those communities.<\/span><\/p>\n<h2>What Types of Cannabis <span style=\"font-size: 27.2px\">Licenses<\/span>\u00a0are in<\/h2>\n<h2><b>Massachusetts?<\/b><\/h2>\n<ul>\n<li style=\"font-weight: 400\"><b>Marijuana Cultivation License<\/b><span style=\"font-weight: 400\">. A Marijuana Cultivator may cultivate, process and package marijuana, to transfer and deliver marijuana products to marijuana establishments, but not to consumers. Your Massachusetts cultivation license application must be for one of the tiers of canopy size. In order to apply for craft marijuana cooperatives, you\u2019d need to have a team that consists of:<\/span>\n<ul>\n<li style=\"list-style-type: none\">\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Massachusetts residents who have formed a limited liability company, limited liability partnership, or a cooperative corporation;\u00a0<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">A business may only have one Craft Marijuana Cooperative license;\u00a0<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Members of a Craft Marijuana Cooperative may not have a controlling interest in any other marijuana establishment;<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">A Craft Marijuana Cooperative is not limited to a particular number of cultivation locations, but is limited to a total canopy of 100,000 square feet and three locations for activities authorized for marijuana product manufacturers;<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">One member of the Craft Marijuana Cooperative must have filed a Schedule F tax form (reporting farm income) in the past five years.<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">The Craft Marijuana Cooperative must operate according to the seven cooperative principles published by the International Cooperative Alliance in 1995.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li><b>Marijuana Product Manufacturer. <\/b><span style=\"font-weight: 400\">A Marijuana Product Manufacturer is an entity authorized to obtain, manufacture, process and package marijuana and marijuana products, to deliver marijuana and marijuana products to Marijuana Establishments and to transfer marijuana and marijuana products to other Marijuana Establishments, but not to consumers.<\/span><\/li>\n<\/ul>\n<ul>\n<li><b>Marijuana Retailer. <\/b><span style=\"font-weight: 400\">A Marijuana Retailer is an entity authorized as a registered marijuana dispensary, licensed to purchase and deliver marijuana and marijuana products from Marijuana Establishments and to sell or otherwise transfer marijuana and marijuana products to Marijuana Establishments and to consumers.\u00a0<\/span><\/li>\n<\/ul>\n<ul>\n<li><b>Marijuana Transporter. <\/b><span style=\"font-weight: 400\">A Marijuana Transporter is an entity that may only transport marijuana or marijuana products when such transportation is not already authorized under a Marijuana Establishment license if it is licensed as a Marijuana Transporter:<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: none\">\n<ul>\n<li style=\"list-style-type: none\">\n<ul>\n<li style=\"font-weight: 400\"><b>Third-Party Transporter<\/b><span style=\"font-weight: 400\">: An entity registered to do business in Massachusetts that does not hold another Marijuana Establishment license pursuant to 935 CMR 500.050 and is not registered as a registered marijuana dispensary pursuant to 105 CMR 725.000 but may transport marijuana.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400\"><b>Existing Licensee Transporter<\/b><span style=\"font-weight: 400\">: A Marijuana Establishment that wishes to contract with other marijuana establishments to transport marijuana and marijuana products to other marijuana establishments.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li><b>Marijuana Research Facility. <\/b><span style=\"font-weight: 400\">A Marijuana Research Facility is an academic institution, non-profit corporation or domestic corporation or entity authorized to do business in the Commonwealth of Massachusetts. A Marijuana Research Facility may cultivate, purchase or otherwise acquire marijuana for the purpose of conducting research regarding marijuana and marijuana products. Any research involving humans must be authorized by an Institutional Review Board. A Massachusetts cultivation license application has a different application fee than a marijuana dispensary application.\u00a0 Other than the application fee,\u00a0 all three (3) sections of the application for any of the license types are as follows:\u00a0<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Application of Intent,\u00a0<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Background Check, and\u00a0<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Management and Operations Profile.\u00a0<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400\">Each section requires applicants to provide accurate information about the business, individuals and entities associated with the business and to demonstrate understanding of, and plans to comply with, the Commission\u2019s regulations that are specific to the applicant\u2019s license type, location, and scale. The adult- and medical-use license applications have essentially the same requirements with differences highlighted in the following sections.<\/span><\/p>\n<h3><span style=\"font-weight: 400\">Application of Intent<\/span><\/h3>\n<p><span style=\"font-weight: 400\">The Application of Intent (AOI) requires the applicant to disclose Persons or Entities Having Direct or Indirect Control in their application for licensure. Persons or Entities Having Indirect Control means any person or entity having indirect control over operations of a ME or MTC. It specifically includes any person with a controlling interest in an indirect holding or parent company of the applicant, and the chief executive officer and executive director of those companies, or any person or entity in a position indirectly to control the decision-making of a Marijuana Establishment (ME) or a Marijuana Treatment Center (MTC).<\/span><\/p>\n<p><span style=\"font-weight: 400\">Applicants are encouraged to include individuals that exert control through the contribution of services. For example, an individual may exert control by making decisions about the establishment management or operations. Applicants do not need to disclose individuals who provide services and do not exert control.
