{"id":234206,"date":"2021-06-30T11:40:50","date_gmt":"2021-06-30T17:40:50","guid":{"rendered":"https:\/\/cannabisindustrylawyer.com\/?p=233629"},"modified":"2024-06-11T06:52:23","modified_gmt":"2024-06-11T12:52:23","slug":"justice-thomas-dissent","status":"publish","type":"post","link":"https:\/\/cannabisindustrylawyer.com\/justice-thomas-dissent\/","title":{"rendered":"Supreme Court Justice Criticizes Federal Marijuana Prohibition"},"content":{"rendered":"<h2><img fetchpriority=\"high\" decoding=\"async\" class=\"aligncenter wp-image-233632 size-large\" src=\"https:\/\/cannabisindustrylawyer.com\/wp-content\/uploads\/2021\/06\/US-Supreme-Court-1024x683.jpg\" alt=\"US Supreme Court \" width=\"1024\" height=\"683\" \/><\/h2>\n<p><span style=\"font-weight: 400;\">On Monday, June 28th, 2021, a surprising proponent to end the federal prohibition of marijuana emerged in the US Supreme Court.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">After the Court denied a review of a Colorado case which dealt with a medical marijuana dispensary and a challenge to a public policy provision in the Tax Code, Associate Justice Thomas, wrote a <\/span><a href=\"https:\/\/www.supremecourt.gov\/opinions\/20pdf\/20-645_9p6b.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">statement<\/span><\/a><span style=\"font-weight: 400;\"> acknowledging that, because of an acceptance of state-level cannabis legalization, \u201ca prohibition on intrastate use or cultivation of marijuana may no longer be necessary or proper to support the Federal Government\u2019s piecemeal approach.\u201d <\/span><\/p>\n<p><span style=\"font-weight: 400;\">He further asserted that the Colorado case that the Supreme Court refused to hear is a prime example of the fact that marijuana businesses do not experience \u201cequal treatment\u201d under the law.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">For nearly two decades now, the US Supreme Court has maintained its decision from <\/span><i><span style=\"font-weight: 400;\">Gonzales v. Raich <\/span><\/i><span style=\"font-weight: 400;\">(2004), which based its usage of the commerce clause on the storied wheat farmer featured in <\/span><i><span style=\"font-weight: 400;\">Wickard v. Filburn <\/span><\/i><span style=\"font-weight: 400;\">(1941). <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Under the <\/span><i><span style=\"font-weight: 400;\">Raich <\/span><\/i><span style=\"font-weight: 400;\">decision, the Court ruled that Congress\u2019 power to regulate interstate commerce authorized it \u201cto prohibit the local cultivation and use of marijuana.\u201d <\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Court\u2019s reasoning was that Congress had \u201cenacted comprehensive legislation to regulate the interstate market in a fungible commodity\u201d and that exemption for local use could undermine this \u201ccomprehensive\u201d regime. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Court stressed that Congress had decided \u201cto prohibit entirely the possession or use of marijuana\u201d and had \u201cdesignate[d] marijuana as contraband for any purpose, prohibiting any intrastate use was thus, according to the Court, \u201c\u2018necessary and proper\u2019\u201d to avoid a \u201cgaping hole\u201d in Congress\u2019 closed regulatory system.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">However, in his statement, Justice Thomas acknowledged that since the decision was made in <\/span><i><span style=\"font-weight: 400;\">Raich<\/span><\/i><span style=\"font-weight: 400;\">, which was meant to solidify the federal government&#8217;s approach on cannabis, Congress has sent mixed signals on enforcing its once comprehensive views. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">For example, between 2009 and 2013, the Department of Justice issued memorandums outlining a policy against intruding on state legalization schemes or prosecuting certain individuals who comply with state law. Additionally, in every fiscal year since 2015, Congress has prohibited the Department of Justice from \u201cspending funds to prevent states\u2019 implementation of their own medical marijuana laws.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">These policies by Congress and the federal government have had significant ramifications, given the vast expansion of US states developing marijuana laws since the decision in <\/span><i><span style=\"font-weight: 400;\">Raich<\/span><\/i><span style=\"font-weight: 400;\">. Indeed, in just the last year, <\/span><a href=\"https:\/\/cannabisindustrylawyer.com\/how-to-open-a-dispensary-in-new-york\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">New York<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/cannabisindustrylawyer.com\/how-to-open-a-cannabis-dispensary-in-new-mexico\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">New Mexico<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/cannabisindustrylawyer.com\/marijuana-business-license-in-virginia\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Virginia<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/cannabisindustrylawyer.com\/how-to-get-a-dispensary-license-in-new-jersey\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">New Jersey<\/span><\/a><span style=\"font-weight: 400;\"> and <\/span><a href=\"https:\/\/cannabisindustrylawyer.com\/connecticut-cannabis-establishment-license\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Connecticut<\/span><\/a><span style=\"font-weight: 400;\"> have all passed adult-use recreational marijuana laws. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Currently, there are 36 states with medical marijuana laws, and 18 of them, and also Washington D.C.,\u00a0 have recreational use laws enacted as well. South Dakota passed a referendum to legalize marijuana in its state, which would have made it the 19th state to pass such a law, but currently the bill was overturned in the courts. Support for complete legalization of cannabis is at 68% <\/span><a href=\"https:\/\/news.gallup.com\/poll\/323582\/support-legal-marijuana-inches-new-high.aspx\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">nationwide.<\/span><\/a><\/p>\n<blockquote><p><span style=\"font-weight: 400;\">\u201cOne can certainly understand why an ordinary person might think that the Federal Government has retreated from its once-absolute ban on marijuana.\u201d &#8211; Justice Clarence Thomas\u00a0<\/span><\/p><\/blockquote>\n<h2>Behind the statement<\/h2>\n<p><span style=\"font-weight: 400;\">Justice Thomas&#8217; statement summed up the incongruity of the federal government when he said that, \u201cthe Federal Government\u2019s current approach is a half-in, half-out regime that simultaneously tolerates and forbids local use of marijuana.
